These Terms of Service ("Terms") are a binding agreement between you and PolicyHulk governing your use of policyhulk.com. By accessing or using this website, you agree to these Terms. If you do not agree, do not use the site.

1. What PolicyHulk is — and is not

PolicyHulk is a free advertising, comparison and lead-matching service. We connect consumers with third-party companies that offer insurance, financial products and home improvement services.

We are not an insurance company, insurance agency, insurance producer or broker; a bank, lender, mortgage broker or loan originator; a debt relief, debt settlement or credit repair company; a credit counseling agency; a law firm or provider of legal advice; a tax advisor; a financial advisor; or a licensed contractor.

We do not issue policies, make credit or underwriting decisions, set rates or terms, approve applications, negotiate with creditors, or perform construction work. All such activities are performed by independent third parties.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use this site. You represent that all information you submit is truthful, accurate and about you — and that you are authorized to provide the phone number and email address you enter.

3. Your submission and consent

When you submit a form, you request that we transmit your information to third-party partners and you consent to be contacted by them. See our Consent to Contact & TCPA Disclosure and Privacy Policy. Consent is not a condition of purchase.

4. No guarantee of quotes, rates, approval or savings

We do not guarantee that you will receive a quote, that any partner will contact you, that you will qualify or be approved for any product, or that any rate, premium, price or savings will be available to you. Any figures shown on this site are illustrative. Actual rates, terms, coverage, eligibility and pricing are determined solely by the third-party provider based on its own underwriting and pricing criteria.

5. Not all providers, not all products

We do not compare or present every company, product, plan or offer available in the market. Our partners pay us, and the order, prominence and inclusion of offers on this site may be influenced by that compensation. See our Advertiser Disclosure.

6. Third-party relationships

Any transaction, contract, policy or agreement you enter into with a third party is solely between you and that third party. We are not a party to it, we receive no fee from you, and we assume no responsibility or liability for the acts, omissions, products, services, licensing, workmanship, warranties or business practices of any third party. Verify licensing, insurance and credentials independently before you hire anyone or sign anything.

7. Acceptable use

You agree not to: submit false, fraudulent or another person's information; use the site for any unlawful purpose; scrape, harvest, crawl or use automated means to access the site without our written permission; attempt to probe, breach or circumvent security or authentication; interfere with the operation of the site; or reverse engineer any portion of it.

8. Intellectual property

The site, its content, design, logos, trademarks and code are owned by PolicyHulk or its licensors and are protected by intellectual property laws. You may not copy, reproduce, republish, distribute or create derivative works from any part of the site without our prior written consent.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY INFORMATION ON IT IS ACCURATE, COMPLETE OR CURRENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PolicyHulk AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A THIRD PARTY, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend and hold harmless PolicyHulk from any claim, demand, loss, liability, damage or expense (including reasonable attorneys' fees) arising out of your use of the site, your violation of these Terms, your violation of any law, or information you submitted.

12. Binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim or controversy arising out of or relating to the site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.

You and we each waive the right to a trial by jury and the right to participate in a class action, class arbitration or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

30-day opt out: you may opt out of this arbitration agreement by emailing contact@topzmedia.com with your name and a statement that you decline arbitration, within 30 days of first using the site. Opting out does not affect any other part of these Terms.

13. Governing law

These Terms are governed by the laws of the state in which PolicyHulk maintains its principal place of business, without regard to conflict-of-law principles. Subject to Section 12, the exclusive venue for any dispute is the state or federal courts located in that state.

14. Changes and termination

We may modify these Terms at any time by posting the revised version. Continued use of the site constitutes acceptance. We may suspend or terminate access to the site at any time, for any reason, without notice.

15. Severability and entire agreement

If any provision is found unenforceable, the remainder stays in effect. These Terms, together with the Privacy Policy and the other policies linked in our footer, are the entire agreement between you and us regarding the site.
